The Legal Requirement
Under the Electrical Safety Standards in the Private Rented Sector (England) Regulations 2020, all private landlords in England must have a valid EICR (Electrical Installation Condition Report) in place. The rules apply to all private tenancies — assured shorthold tenancies, periodic tenancies, and most other residential lettings.
The electrical installation must be inspected and tested by a qualified and competent person at least every 5 years, or at the start of each new tenancy if the existing report has less than 5 years to run.
What Happens if You Don't Have One?
Local authorities can issue a remedial notice requiring you to carry out the inspection within 28 days. If you fail to comply, they can carry out the works themselves and recover the cost from you, and issue a financial penalty of up to £30,000.
Beyond the legal risk: your buildings and landlord insurance may be invalid if there's no current EICR, and in the event of an electrical incident at your property, you could face serious liability.
What the EICR Must Include
The report must be carried out by a "qualified and competent" person — which in practice means a registered electrician (NAPIT, NICEIC, or another government-approved scheme). It must cover every circuit in the property and classify any faults or deficiencies found.
You must provide a copy to existing tenants within 28 days of the inspection, to new tenants before they move in, and to your local authority within 7 days if they request it.
What Happens if Faults Are Found?
C1 faults (danger present) and C2 faults (potentially dangerous) must be remedied within 28 days of the inspection report. The electrician who carries out the remedial work must then confirm in writing that it has been done — this is typically a Minor Works Certificate or an Electrical Installation Certificate.
